penn. muslim judge rules that it is ok to assault someone that insults mohammad

I have not been able to come up with a reliable source for this. Fox News, Jihad Watch, Islam Watch and other such nut job sites are the only ones I can fine reporting this. No one reputable or reliable has. This story has not been reported by the AP or UPI or Rueters. Mark Whittington is also a notorious right wing blogger. This doesn't pass the smell test.

One should keep in mind any nut on the bench can make any ruling they want. That doesn't make it precedent or law.

Ha, just what I thought. A little more research shows that Judge Martin is not a muslim and that he berated the man who was assualted for being ignorant of Islam (he is) and for provoking a confrontation (he did) and pretty much handled the situation like it had been a bar fight. The facts are that the Judge is not Muslim nor did he site Sharia law in any way what so ever as part of his ruling.

I'm not an attourney and I don't know if Judge dissmissing the case on the bases that the defendent provoked a confrontation is either a legitimate or legal grounds for dismissing the case but it doesn't seem unreasonable from where I sit. I've known of judges to dismiss misdemeanor assault casses cause the defendent was an asshole who provoked the assualt. I know that from personal experience when an aquantance of mine took offense to a black man being at a local bar. He confronted the black man and I personally heard him call him a "nigger" three times. The third time was to much and the black guy popped him in the mouth and knocked him on his ass. The black guy was promptly arrested and charged with assualt. The charges were later dismissed by the local judge when testimony of witnesses that the defendent had been confrontational and repeatedly called the man a nigger.

Anyways my main point is, is that the right wing bloggers who have been reporting this have been grossly dishonest and in most cases have out right lied in reporting the facts of this case.

DQ, it looks like a straight-up harassment charge that was dismissed for lack of evidence.

A district judge dismissed a harassment charge against a man accused of attacking a man dressed as "Zombie Muhammad" during a Halloween parade last year in Mechanicsburg.

Judge Mark Martin said there wasn't enough evidence to convict 46-year-old Talaag Elbayomy of the summary offense. It was basically one man's word against another's, the judge said.

Elbayomy was accused of attacking Ernest Perce V, of the Parading Atheists of Central PA, during the Oct. 11 parade. Perce claimed Elbayomy tried to take his "Muhammad of Islam" sign and choked him.

Martin received testimony from Elbayomy, Perce and Mechanicsburg Police Sgt. Brian Curtis who received the complaint from Perce. Curtis did not witness the alleged attack, Martin said.

it worked out this way because the two people involved were low life citizens, not exalted police officers. a cops word would have been accepted as gold.

One man's word against the other....?...Lack of evidence ?

sounds like bullshit to me....it happened during a public parade and nobody saw anything....nobody heard anything....???

The Muslim got pissed because he thought someone was dissing Muhammad and attacked the guy.....Guilty....case closed....

And no, you won't hear about this on others stations except Fox......the liberal Obama msm don't dare report anything that might cast a bad light on Islam....

It is actually a legal reason to dismiss a case, the technical term is victim precipitation. While it's not always a cause for dismissal I think the judge had it right here, it was a bar fight, a night in the cells to cool down sure, but actually charging somebody is right out. Thanks for taking the time to find more information.
