You are assuming that IRS withholding tables are part of the tax code (i.e. statutory law). I don't think that they are. If they are, obviously he couldn't do it. If they're aren't statutory law but simply IRS publications, there's nothing unconstitutional about it.

No, what I did was misread what you wrote. For some reason when reading it, I thought you were saying the IRS should not raise the lower tax brackets. But you are saying have businesses (via the IRS tables) withhold taxes for those making under $250k as if those brackets would eventually be returned to the Obama tax cut levels.

Like the lower tax brackets, the AMT can be fixed retroactively. That is not a problem.

Refunds? What the hell are you talking about? The only issue with letting the tax cuts expire and then negotiating is the IRS withholding tables and people having money withheld from their paychecks on the basis of the increased rates while the negotiations progress.
