Indeed you are. I'm not a lawyer but I can read. What is considered to be a Presidential record is solely up to the President to decide. Or at least that is what a federal judge says.

That is impressive ignorance. When you enter public service the treatment of classified documents is spelled out. There are rules and procedures involved. Trump did not follow them. Trump stole a truckload of classified documents. His claim that he could classify and unclassify in his mind simply ends the classification system. Who would ever know what is classified? I suppose the people in jail for misusing classified documents would have to be released. Sandy Berger didn't go the jail for stuffing classified documents down his pants and walking out of the National Archives......
In 2005, he was fined and sentenced to two years of probation, plus community service, for the unauthorized removal of classified material from the National Archives.

Sandy Berger did not lie to the FBI about having those documents and did not try to destroy the evidence after the records had been subpoenaed. Sandy Berger did not try to interfere with the Constitutional transfer of power of the presidency. Sandy Berger did not try to install himself as an unelected leader of the United States.
