roberts, maybe. alito, less likely. scalia? hard to get past that and no Warrants shall issue, but upon probable cause, supported by Oath or affirmation in the 4th Amendment, of which scalia is extremely touchy about usurping any of his power on the bench.
 
Zero judicial scrutiny... Who is it that promised to uphold the constitution? Isn't that part of their oath too?

The problem is they are in secret. What it does is allow them to tap your crap and get information. They even can do a search of premises without your knowledge. It's sick stuff.

I'm stunned. Remember the protests about warrantless wiretapping? Not stopped either... You seem to have no issue with their use so long as the Great Leader is in charge.
 
Obama got Osama but not before Osama got us all. 9-11 changed everything. The people who believe in security before freedom have played into the hands of the terrorists and we are worse for it. The founders of this nation would weep.

this is an interesting topic. before 9/11 i loved flying....now, hate it. will not do it unless absolutely necessary, unless in a friend's airplane. i wonder though....even without 9/11...would we have "upgraded" our airport security eventually? it was very lax. i speak only to airport security. i think it would have had to upgraded with or without 9/11. without 9/11 i don't think we would have the fear of shampoo and water or whatever it is they don't let you bring aboard planes ( i have not flown since 2002, though i will for the hawaii trip this year)

We have certainly done that over the years. You used to be able to walk right up to the plane in order to greet or say farewell to friends, associates, and loved ones. You could no longer do that on 9/10. Just one gaping example, there.

Right, just because he didn't invent the baseball bat we'll pretend that when he uses it to rob you it isn't "his" fault. The fact is warrantless wiretapping and this policy in the OP have been strengthened and increased respectively. Yeah, that's all on Obama. It isn't pretense to criticize actual action and policy. It takes blinders to "miss" this kind of thing.

He has a "D" by his name so you will use any excuse for his actually strengthening this policy, using it more often, ensuring you cannot sue. No, Obama jumped on and started whipping that horse harder and suddenly you are left trying to defend what you previously believed to be indefensible. Gross partisan hypocrisy. And you danged well better bet I was against this rubbish when Bush was getting the D led congress to give him all that power.

the trouble is that the genie is out of the bottle - so how do we get it back in - we can be sure that the reps will not do it, all we may do is hope that obama does during his second term - if he tries now the reps will slam him, although with osama dead maybe he could get away with it
