There must be actual evidence, not just an allegation to remove the prosecutor.
Not only is there no evidence, the one witness that Merchant had refused to testify that there was any relationship prior to Wade being hired.
The judge can't rule based on no evidence. The standard is much higher than that. The judge is bending over backwards for the defendants (which includes Trump) but in the final ruling he has to rely on actual evidence.

2 people testified there was no relationship prior to Wade's hiring. (One person testified Fanni brought a boyfriend that wasn't Wade home during the time frame before she hired Wade.)

No one testified that she didn't pay Wade back.
You are free to think Wade and Fanni are lying, the judge is not free to do so. He is required to have evidence. This case is pretty much a slam dunk but it isn't going to be the way you want it to turn out.
