No, additional charges. Not double jeopardy either. It’s not the first time the Feds stepped in to resolve justice.

Terrorist charges, perhaps? If Kyle’s militia is charged with terrorism, Kyle would be caught up in it…unless he rolled on them.

FWIW, I doubt Kyle knows much since he has patsy written all over him.

Yep. And you are unlikely to get that if the defendant is found not guilty because you wouldn't allow "prejudicial" facts to be presented. More likely if you *did* allow something that an appeals court might find prejudicial, like fatmurderboy consorting with the militias while out on bail. That Kyle did so had nothing to do with the events in Kenosha though, so IMO the judge was most likely correct in disallowing that. But his pre-event statements about going there and shooting ppl should have been allowed because it speaks to state of mind and why he was there.

A side part of this is something the WSEs fear and facts have revealed to often been true; they’ve been infiltrated by the FBI. The Feds don’t want to have a multi-year case blown over a minor case, even a couple of murders. A successful terrorist attack would murder hundreds of Americans. Ergo, the greater need is to stop the terrorists even if a punk kid is found not guilty in a murder case because of a Federal gag order.

These rules were literally ignored and bypassed by the local judge, junior was 17 at the time and obtained a weapon from a 20 year old "friend, but neither was "hunting".

Agreed…unless they had a reason to hold off. There is no statute of limitations on murder or terrorism that results in death or injury. Note that those materially supporting a terrorist attack would be subject to the same charges just like a getaway driver of a robbery resulting in a murder.

This means if Sgt. Doolittle or Captain Earl gave money or ammo, helped plan or otherwise materially supported a terrorist attack then, even if they were at home during the event, they would be charged.

For capital crimes, such as the capital murder, there is no statute of limitations (18 USC 3281). . Terrorism is also not subject to any statute of limitations where the offense caused death or serious bodily injury or harm (18 USC 3286). Sexual offenses against children also have no statute of limitations (18 USC 3283) .
