undocumented aliens are NOT charged with a crime for their first entry. It is a civil process and if you are found to be here without inspection then you are sent home, usually with a restriction on re-entry for some period of time. Only a subsequent re-entry without inspection is a criminal offense. So technically, under US law, many undocumented aliens are not criminals.
 
Not all illegal immigrants are criminals. The propaganda of the right has clearly confused many people on this issue, even Arizona police officers.

They cannot be criminally prosecuted...but they CAN be deported and even refused re-entry for non compliance to the law! It's really a moot point if any point at all. When they stay on an expired visa they are here illegally. The penalty is not prosecuatable criminally as it is for those illegals who entered illegally...but they are still illegals nonetheless!
 
We on the Right don't actually want to get rid of the cheap laborers we import, we just want to stop them getting uppity like the Negroes did.

What the hell are you talking about? Illegal immigrants are criminals is propaganda spread by the anti immigration forces. It is certainly not a moot point that that is not true.

It is also not a moot point in the way laws may be applied to them and leos may interact with them. It means lack of documentation is not probable cause of a crime because one can admit they are illegally present and that is still not probable cause of the crime of illegal entry (Gonzales v Peoria).

It is not a moot point, dumbfuck. It's going to a primary reason this law will be shot down or shot full of holes.

SO, IMO, Your point is MOOT! Your differentiation silly! Congress attempted to correct this ridiculous differentiation in 2006 and senate democrats shit all over it!

Because it would have been a nightmare for the courts. That's not going to streamline anything you, idiot. Do you know what kind of resources would be required to prosecute these newly created crimes? I hate to say it, but Rudy, again, was correct on this. But, then he is not one of the Republicans living under a rock. The attempts to criminalize illegal presence are about "streamlining" GOP propaganda to reality. It's just a political stunt. It's passage would do nothing but clog the courts and bog down the enforcement of immigration laws.

I assume you are aware that when someone is found to be in the country illegally, that they are going to see a Judge regardless; unless it's their first time and they voluntarilly deport.
Those under 18 have to see a Judge, no matter what.

Sourced from 2006, so like I said; would you have anything more recent and maybe from a source that doesn't have a vested interest in illegals staying in the US.

Law officers have apprehended 17 suspected illegal immigrants while hunting for suspected smugglers who shot and wounded a sheriff's deputy in a remote desert area 50 miles south of Phoenix.

Pinal County sheriff's Lt. Tamatha Villar says three of those captured match descriptions given by the deputy. They were being questioned Saturday morning.

The violent episode came amid nationwide debate over the state's tough new immigration law.

Deputy Louie Puroll was patrolling alone Friday afternoon near Interstate 8 when he came upon a stash of marijuana bales and five suspected smugglers. Villar says the smugglers opened fire with AK-47 type rifles, and Puroll returned fire.

The wounded deputy radioed for help, setting off a frantic hour-long search before he was located
