Although I can see why he used it because filing charges under the PRA would have gotten him nowhere.

Now what is interesting is that according to precedent new laws override existing laws and what Trump is charged with does fall under PRA rules meaning that it will overrule the espionage act.

Smith is going to have to prove in a court of law that the records Trump had were not only used to try and damage the nation but that they actually did.

About 10 of the charges are going to rely on Trumps intent to use them to hurt the nation, the others are going to have to be proven to actually have harmed the nation in some way.

That is a tough thing to prove in a court of law.

Showing a document to a friend isn't really going to cut it.

So these 31 charges are essentially meaningless, they won't stand up, it's the other six that are going to be problematic for Trump. Trump's defense has to prove that he had a legal right to them, Smith has to prove he didn't.

Whatever the jury decides will ultimately end up in the Supreme Court however.

If you are not stupid, like PmP you recognize the first is protected Free speech even if a knowing lie. You will not be prosecuted for it.

If you are not stupid, like PmP you recognize that when you take action based on those words, and do actual ACTIONS that are illegal and get charged for those ACTIONS you are NOT being charged for your speech.


You would think a claimed lawyer would not have to have that explained but then i spend more time correcting PmP on legal issues than any other poster here.

In what everyone knew should have been a slam dunk, Red Wave Midterms for the GOP, gutting the Dems, the simple imposition of Trump into the mix caused a significant shift of seats to Dems. All of the district balances indicated they would go Red in any other year and pretty much no one on the right or left had any other expectation.

Enter the Trump factor and suddenly that all goes away and republiclowns massively underperform.


I will be honest as Trump did get something right. And that is with him on the ticket, I am starting to get tired of how much winning we are doing.

The TrumpDerp psychology is one that requires them be victims.

There is nothing they do more than cry and cry about how they are abused and taken advantage of. It is now an embedded part of their personality.

So losing elections is also core to that. It allows them to wallow in self pity about how unfair the entire country is to them and how every system is repressing them (Courts, Congress, etc).

Losing elections is the ultimate manifestation of their need to be losers and cry about and thus why they cannot help themselves and they set up loss after loss even when they could easily win.

And i am not saying they do this necessarily consciously. It is like an abused woman who keeps paring with abusive men and cannot break the cycle as she is unable to see if from her vantage point. But others can see it clearly.

That's it, those should be the only two charges against him in that case.

They both cover everything that happened yet Smith has broken them down further into 29 more separate charges all of which would be covered under the first two charges.

This is a main reason why Smith's case is so weak.

He is charged with 4 counts in Washington DC.
