Trainor can not legally give advice on NY law. He is not a lawyer in NY. He has not studied the NY statutes. He may be violating his legal ethics by giving legal advice under oath he is not legally authorized to give.
Massie then gets the FEC commissioner to admit they would thoroughly investigate any complaint of payment to hide up an affair to hide an election.

Bragg listed them in a court filing before the trial. Trump's lawyers responded to the filing by Bragg before the trial. The judge ruled on them before the trial. Prosecutors listed them in their opening statement. Prosecutors listed them in their closing statements. The judge ruled on what would be in the jury instructions. Trump's lawyers filed a motion about what could be included in the jury instructions. Finally the judge included them in the jury instructions.
To claim Bragg couldn't list the possible other crimes is the height of sticking your head in the sand. Are you really this stupid? It seems you are.
Read page 12. This is the judge's ruling on Feb 15, before the trial.
It lists the 4 other crimes that Bragg says are possible to elevate the charged crime to a felony. The judge rules on them, that 3 of them were presented to the grand jury.
The Court has considered the respective arguments of the parties and finds that the
evidence presented to the grandjury for the first three theories was legally sufficient to support
the intent to commit the "other crime" element of falsifying Business Records in the First Degree.

He listed them on multiple occassions in court and in court filings and presented them to 2 different juries, the grand jury and the trial jury.

Trainor is not THE commissioner of the FEC. There are six commissioners for the FEC. They each have equal votes on what is a violation. Trainor does not get to decide what is a violation of the law. His vote can be easily outvoted.
