According to former prosecutor Glenn Kirschner, special counsel Jack Smith should expand his investigation into the Jan. 6 insurrection by including Fox News for spreading election lies that helped incite the violence that occurred that day.

Appearing on "The Katie Phang Show," the attorney noted the text messages between high-profile Fox News hosts admitting they knew the election fraud claims were lies but spread them on-air anyway because it was helping with their ratings.

Speaking with host Phang, Kirschner stated he believes the network helped incite the riot and that the Department of Justice should open an investigation based upon the new revelations.

"These were not lies about which toothpaste will make your teeth whiter, or which floor wax will make your floors more shiny, these were lies about whether the American peoples' votes were stolen and their election rigged," he told the host.

"It's like they were packing the case with gunpowder, using these lies as a vehicle to keep the viewership, you know, engaged," he continued. "They were just waiting for Donald Trump to light that gunpowder -- which he did on January 6th and it erupted into violence."

"I think we need to challenge the federal government -- this defamation suit is important -- but what is even more important is the federal government needs to step up and address these intentional and reckless lies," he elaborated. "I would argue are reasonably likely, if not intended to, incite imminent violence. This issue has got to be grabbed onto and shaken and addressed."

Constitutional protections of a free press would make prosecution of Fox almost impossible regardless of their status as a fountain of misinformation.

If they can't be prosecuted, we need to ramp up the ridiculing.
 
I doubt they face criminal liability, but they have certainly shed their last remaining claim to be fair and honest. The pleading we saw demonstrates clearly that they garner viewers by lying to them, and they continue to lie in order to maintain viewership. That is not news. That it is not journalism. It’s a naked money grab using ignorant and hateful rubes to enrich themselves. And the rubes STILL are not waking up. I guess the cognitive dissonance would be too much.
 
A selection of those rubes are right here on this board. Either they don't care if Fox (and Trump) are lying, or they fell for it all. Either way it's a waste of time arguing with them.

One of the defining characteristics of this group is their unwillingness to ever admit a mistake. You point out the lie, they just move on to the next one. They'll never stop. I agree.

It has been according to the WOKE time to shut down Fox News by force for years.

Who has the power for that? C'mon you can do better. Fox is in trouble because they spent a year lying about a company that was involved in elections, wrecking their business. They did financial damage to them and got sued. This is all Fox's fault because they have no values and are dishonest.

Ahhh, but if you are knowingly and willingly "reporting" and perpetuating false information that benefits one political party, then you are no longer a "free press", but instead a propaganda outlet.

I'm not a constitutional export and am in fact an outspoken critic of the possibly well-intentioned but poorly written document.
Nonetheless, I'm unaware of any 1st Amendment exclusion for propoganda.
 
The old saw " a camel is a horse designed by a committee" comes to mind. The constitution had to serve states with conflicting values, including slavery. Madison drafted it with input by mail from several founders. They knew that the constitution was a snapshot of a changing time. Franklin said every 19 years, it should be totally rewritten. They knew it would not be ideally suited to the future. There is nothing holy about it. They wrote ambiguously. The 2nd amendment is an example.
