I think it is more harmful to be so worried about not "clogging" our courtrooms that we allow the worker and the consumer to be harmed at will.

I do not believe that clogged courtrooms is on any list of the most pressing problems the people face.

It is the COST that concerns me. OR do you think that all of these lawsuits simply don't effect the economy at all?

"oh, no, my boss said something mean to me...." time to sue....

and to be perfectly clear... no one said that the workers could be harmed at will. AND this has nothing to do with consumers.

The point was to make the laws clear.... something you are either ignoring or simply choose not to address.
 
Let me see.... We already have complaints about how overclogged they are. Let's make the laws as vague as possible so that everybody can have a lawsuit going!

Well, I don't complain about it, and I swear to God, I can honestly tell you no one I am around, or have ever been around, "complains" about clogged courtrooms. I mean, boy, talk about last on your list of real people's concerns.

No, I don't think they do effect the economy in any measurable amount SF. If you can show me otherwise, I would certainly say that I am wrong.
 
Like I said... a trial lawyers wet dream. A completely vague and subjective law that means open to a wide range of interpretations. But who cares, let's further clog our court systems with BS lawsuits and let judges determine what each vague law means to them.

I looked up the New Jersey bill, and your fear about the "vaugness" is probably misplaced.

This is a pending bill I think, that hasn't even been voted on. They don't even make amendments and additions to bills until the committees and conferences mark it up.

I don't think a lot of bills that get introduced have an excrutiating amount of detail in them. That's what the legislative process is for.

It does have to do with consumers. People who complain about this kind of lawsuit, complain about "frivilous" consumer suits as well. I will bet you have put up a thread in the past about a consumer suit you didn't like?

I did not ignore it, I stated, there is no way to really make that clear. Even the courts have said this. For instance, on pornography, "I know it when I see it". The same with sexual harrassment, it is an atmosphere created, you cannot be that specific because by doing so, you rule out certain situations and kinds of harrassments. It's a case by case judgement for the most part.

I think you would be more concerned if it was your lawsuit that wouldn't be heard for a couple years and would take more than a decade to make it through appeals.

The appeals process is dragged out by corporations who lose lawsuits, and less lawsuits isn't going to change that.

You know what, that's a price I'm willing to pay to ensure that consumers and workers have protections. There are always going to be some who misuse laws. Even rape laws are sometimes, (rarely) misused. Does that mean we should make rape legal so we don't "clog" up our courts? Of course not.

I prefer the laws be very specific so that we are not spending that much time, freeing up the judges to strike down drug laws.

And no complaints about one agreeing with the other one either. How odd. I know i can't agree with anyone around here without being rode all day about it.
