Also, if the police had not been involved in the phone call or the recording, it would have been perfectly legal and admissible in a court for that recording to come in. Colorado is a one-party state and therefore the person being called does not have to be advised that the call is being recorded. California, Connecticut, Florida, Illinois, Maryland, Massachusetts, Michigan, Montana, Nevada, New Hampshire, Pennsylvania and Washington are the only two party states in the US. All other states allow you to record phone calls without informing the other party. ALSO if you are calling someone in one of these states from a one party state, it is best to observe the two party law. There is only one case that I am aware of and it is a California case. But I would err on the side of the two party consent law state. Also, the fed only requires that one party consent to the recording of the phone call unless recorded with a valid warrant allowing for a wiretap. 18 U.S.C. Sec. 2511(2)(d). One more exception is the business telephone exception, your employer is allowed to record ALL your phone calls on phones they provide without notifying you.
Wow tangent alert. Sorry, guess what I was trying to say is that the Greely police fucked the pooch on this one. Someone should have "suggested" to her that she go home and call him and record. Then he would have been fucked.
