Wrong. The perception of someone in that split second could easily be that they're about to be hit by the vehicle--hard. She was under full acceleration and that's proven by the fact that the van hit that parked car and telephone poll in about two or three car lengths hard enough to set the airbags off.

Then he would have stepped back more, instead of holding onto his cell phone, unholstering his firearm, aiming & firing.

The acceleration ONLY happened after she was shot. And it created a more dangerous situation on that street.
