The father is in jail and is awaiting trial. He is facing the consequences.

But, as has been suggested in this thread, he will probably be able to use a temporary insanity plea.

I doubt it. You'd have to check to see if such a plea is even allowed in that particular state, most don't care to give it credence. Either he knew what he was doing was wrong or not, and my bet is he knew and decided the consequences were worth it.
