Were his rights violated?

A University of Maryland honor student who warned on websites he was going to "kill enough people to make it to national news" was arrested after several people reported the threat.

The initial threat was posted on Reddit.com, a user-generated news website.

Police said two more threatening posts were reported by people who were chatting with Song.

In one of the chats, a person said he was going to call the police unless Song admitted that he was joking around, the police chief said. Song responded by saying "LOL. Go ahead. You don't even know what campus I'm talking about".

Song also warned people to "stay away from the mall" on Monday.

Detectives traced the messages to a computer used by Song and arrested him on campus after setting up surveillance to track his movements.

By Sunday, authorities had set up surveillance on Song and arrested him.

Song was not armed at the time of his arrest, and police did not find any weapons in his dorm room or his parent's home.

Song, a 19-year-old sophomore, was shaking and crying when he was taken into custody.

threatening someone is a crime. making a threat like this should absolutely result in arrest. and if genuine, prosecution for attempt.

The point is whether he was making threats or actually planning to commit a crime, it's a distinction that generally goes to the discretion of the police and DA. I have no idea where this falls, but no I wouldn't say his rights were violated.

It's to bad that jumping to conclusions doesn't qualify as exercise. If it did, you'd be in good shape.

seeing as how they had surveillance on him but found no weapons on him, in his room, nor at his parents house when they arrested him, it looks to me like they violated his rights. maybe they'll come up with some power point presentation he made on what he planned to do, but I see no crime other than a college kid being a dumbass. if that becomes illegal, we're gonna need a whole lot more prisons.

If they had the arrest warrant then no rights were violated, whether or not he is prosecuted is entirely up to the DA, personally I agree that he was guilty of no more than being a dumb college kid, but assuming the police had a warrant(and I think we'd hear if they didn't) his rights weren't violated.

he is guilty of making terrorist threats under the usa patriot act
