The Kalief Browder story is a sad one, no question. And it's good to see NY made changes to system as a result. No kid should be forced into solitary confinement for 23 hours a day like he was. And unacceptable the length of time and all he went through. It's fvcked up. But as I understand it he wasn't given bail because he was already on probation. If that's the law, that's the law. This chick in D.C. had no prior record and thus was given bail.

Who the fuck puts a 16-year-old in prison at all, much less solitary, for stealing a backpack? It's fucking nuts, and it serves literally no one's best interests.

I'm not from New York but if what I read was correct 16 year olds in the state can (or could be at the time) be tried as adults. Without any other info, I would assume that is how a 16 year old ends up in jail.

The issue is that Kalief Browder did not even get a trial, much less bail. He spent 3 years in jail without getting a trial.

They were unable to make a case against Browder, so they just held him without bail for 3 years, from age 16 to age 19. He literally lost those years.

Repeatedly, he was offered immediate release, if he just pleaded guilty. He pointed out that he was innocent, so had to spend more time in jail. After over 3 years, the prosecutor admitted they had never had a case against him, and had just drawn things out trying to get him to plead guilty.

Browder was standing next to a car that had been stolen. He claimed he had not stolen the car. He was held for a week in jail, and then offered immediate release if he plead guilty. He thought it was a good deal, and took it to get out of jail.

When he was arrested later for allegedly stealing the backpack, but no evidence was found on him, he was not in the area when the crime was committed, and the only witness gave conflicting stories, and was not willing to testify. Realizing they had a weak case, prosecutors took the unusual step of violating his probation, and locking him away without bail for years while they asked for drips and drops of extensions. Basically, they punished him for not confessing to something he had not done.

I was speaking specifically to the fact about bail, and that as I read it, he was not given bail because he was on probation. I'm not from New York. I don't know New York laws but I'm assuming in New York that was the law. If that's wrong feel free to tell me otherwise. The chick in D.C., as I read it, was given bail because she had no prior record.

It's very unfortunate.
But, perhaps not so out of the ordinary.

My father taught kids like these in prison for a long time. Including Southern Westchester BOCES in Valhalla area , DFY in Wingdale & Lincoln hall in Somers.

Technically, Browder could get bail, but because his probation was violated, he would not be released. He was technically serving the time from his original guilty plea.

Probation would not usually be violated just because there were charges, especially if those charges were weak. After 3 years, when the prosecutor finally admitted there was no case against Browder, the probation officer had to also admit Browder's probation had never been violated.
