Just a perspective on things as they are:
For a good part of my life, any and all legal motions and law enforcement acts regarding folk immigrating to America or seeking political asylum was handled by the INS - Immigration and Naturalization Service. It was first under the Labor Dept. from 1933 to 1940, the under the DOJ until 2003.
But when the DHS was created in 2003 as a panic response (or was it planned in the PNAC document a few years earlier), the INS was fragmented into 3 sections; Citizens and Immigration Services, Customs and Border Protection, and Immigration and Customs Enforcement (ICE) that all fall under DHS jurisdiction .... the DHS being an amalgamation of various formally separate agencies (i.e. FEMA). This essentially gives them a somewhat "gestapo" type power that can (and has) work at the behest of the Executive Branch, coming close to stepping on the toes of the FBI and NSA.
