Imagine booking someone for (suspicion of committing) a crime. Imagine taking finger prints and photographs. Imagine the Salvadoran embassy stating that s/he's a citizen of El Salvador. Imagine taking that evidence/documentation to a judge.
... or imagine a credible witness declaring that said detainee is also an illegal immigrant from his country, that they immigrated together illegally, and taking that testimony to a judge.
... or imagine that said detainee confesses to being an illegal immigrant from El Salvador, and then he becomes motivated to make that confession before a judge.
The short answer is that all people for whom there is evidence of illegal entry into the United States be considered for determination of national origin.
Based upon evidence, of course.
