Would you tell your girlfriend that they had pulled a gun on you?

Would you call your girlfriend, if you thought someone was following you?

Would a reasonable person, if they thought some guy was following them, call their girlfriend, then sneak up, sucker punch that person, and begin slamming his head against the sidewalk?
 
Exactly, I don't get this leaving the scene, you are suppose to stay put till police arrive, isn't everyone aware of this part of our law?

Even if they are (and they should be) aware, taking the life of another is a pretty traumatic experience, all the more so if it's in self defense. Lapses of judgement and irrational or illogical acts aren't exactly unheard of.
 
Ordering a pizza after you've shot someone doesn't seem like someone having had a traumatic experience, grant it, maybe he was intoxicated (which in the case of operating a motorvehicle he was breaking the law anyway) and I tend to think any "shocking" or traumatic experience would indeed sober anyone up quickly. there is something fishy about someone shooting someone, going home to order a pizza. By the way was a gun recovered from the party who he THOUGHT had a weapon?

Nah - There's a question as to what might have occurred, after they drove away; because there was enough time to hide any other evidence.

Some time between then and the next day when you were on a 3 hour car ride with her, do you think you would have told your girlfriend that the reason you shot them was because they had a gun?

yes I would. but I don't know if I am willing to bet someone elses life on it.
 
Cool. Not a habit I've created. I would then talk about how they were reasonable at some points, later times (seemingly unrelated) I would ask what would a "reasonable person" do for each separate action... The association would be made, I would probably win, and I would be happy.
As a Jurist...capable of critical thinking and not mindlessly being led to a particular conclusion by a lawyer I would ask my self two fundamental questions.

#1. Is there evidence, beyond reasonable doubt, that these young men posed an explicit threat to Mr. Dunn's life and limb?

If not...

#2. Were his actions premeditated?

If the answer to question #1 is Yes, then he's not guilty.

If the answer to #1 is no and the answer to question #2 is yes, they he's guilty of first degree murder. If the answer to question #2 is no, then he's guilty of 2nd degree murder.

Why? Does it have anything to do with whether or not an actual threat existed to Mr. Dunn's life and health? No it does not.

Then I would ask myself. Self, why is this Lawyer insulting my intelligence by asking an irrelevant question?

The theory is that his self defense argument did not develop until later and thats why its relevant, he did not share it with anyone until having time to think.
 
Your turn now. If they had a gun, why didn't they stand their ground?

That would probably be a question you would need to ask them; unless you're trying to suggest that anyone who is armed, is always going to draw and shoot someone they are having a disagreement with.

There not usually required to have anything to do with FACTS.
