It takes government employees to let other government employees off the hook for crimes. The people have lost control

By the time of his first arrest at 15, Carlos De Luna was a 7th-grade dropout who liked to sniff paint and glue.

His rap sheet eventually would include nearly two dozen crimes, mostly offenses such as public drunkenness, disorderly conduct, auto theft and burglary. He was in and out of juvenile detention, but it wasn't until a 1980 arrest that he faced time in an adult prison.

He was then living with relatives in Dallas and working at a Whataburger franchise. Charged with attempted aggravated rape and driving a stolen vehicle, he pleaded no contest and was sentenced to 2 to 3 years.

Paroled in May 1982, De Luna returned to Corpus Christi. Not long after, he attended a party for a former cellmate and was accused of attacking the cellmate's 53-year-old mother. She told police that De Luna broke three of her ribs with one punch, removed her underwear, pulled down his pants, then suddenly left.

He was never prosecuted for the attack, but authorities sent him back to prison on a parole violation. Released again in December of that year, he came back to Corpus Christi and got a job as a concrete worker.

Almost immediately, he was arrested for public intoxication. During the arrest, De Luna allegedly laughed about the wounding of a police officer months earlier and said the officer should have been killed.

Two weeks after that arrest, Lopez was murdered.

no part of the criminal justice system will ever face any charges for this murder. It's not a state law that shields the prosecutor, it's the USSC and their invented right of absolute immunity for prosecutors.

yes, the people have lost control of this country, but nobody wants to believe me about it. It's not like i've been posting about this shit for years now.
 
The possablity of this happening is the main reason I am against the death penalty. It is impossable to ensure swift and sure punishment while also ensuring that the innocent are not killed.

prosecute the prosecutor. Charge them with negligent homocide.
Prosecutors are exempted from such prosecutions. According to them it would undermine the legal system. I say that's bullshit. They should be help accountable for incompetence and malfeasance of office like any other professional would be.

They won't be prosecuted because they have qualified immunity.
 
if there wasn't prosecutorial misconduct, then it's really a non-issue. The jury saw the evidence presented to them, and all 12 of them came back with a unanimous verdict. The judge could have thrown out the verdict, but upheld it. A prosecutors job is to speak for the victim, and present the states case. It is the jury's responsibility to be finders of fact and determine the verdict. (duhhh)

In ancient rome (i forget this source but I remember reading this once),they had this system where if a man was no convicted of a crime, the prosecutor would be branded with the letter 'K' on their forehead. This would serve to stop erroneous prosecutions.

At the end of the day, we really don't like killing innocent people, but killing guilty people is awesome. I doubt the death penalty is going anywhere for quite a while.
