Checks and balances. The Supreme Court interprets law, it does my create it. When congress creates law based in political belief and political ideals that are not granted to it in the construction then it's unconstitutional, and if the court sways one way or another based on political leanings, which they do have, it can reinforce that unconstitutional law through it's decision making, but that does not mean it's right.
