Because in the case of Menendez, he's a small fish in a big pond and better to let it go that fight it.

In the case of Bribem's son, the DOJ was backed into a corner by an honest federal judge that wouldn't put her name of a massively illegal deal.

As for Joke pardoning his son, we shall see on that. My bet is if Bagman (Hunter) is convicted, daddy Joke will pardon him like one week before leaving office, much like Clinton pardoned Marc Rich in that manner for a big "campaign contribution" (aka bribe).
