Berkeley council tells Marines to leave
By Doug Oakley

Hey-hey, ho-ho, the Marines in Berkeley have got to go.

That's the message from the Berkeley City Council, which voted 6-3 Tuesday night to tell the U.S. Marines that its Shattuck Avenue recruiting station "is not welcome in the city, and if recruiters choose to stay, they do so as uninvited and unwelcome intruders."

In addition, the council voted to explore enforcing its law prohibiting discrimination on the basis of sexual orientation against the Marines because of the military's don't ask, don't tell policy. And it officially encouraged the women's peace group Code Pink to impede the work of the Marines in the city by protesting in front of the station.

In a separate item, the council voted 8-1 to give Code Pink a designated parking space in front of the recruiting station once a week for six months and a free sound permit for protesting once a week from noon to 4 p.m.

Councilman Gordon Wozniak opposed both items.

The Marines have been in Berkeley for a little more than a year, having moved from Alameda in December of 2006. For about the past four months, Code Pink has been protesting in front of the station.

"I believe in the Code Pink cause. The Marines don't belong here, they shouldn't have come here, and they should leave," said Berkeley Mayor Tom Bates after votes were cast.

A Marines representative did not respond to requests for comment.

The resolution telling the Marines they are unwelcome and directing the city attorney to explore
issues of sexual orientation discrimination was brought to the council by the city's Peace and Justice commission.
The recommendation to give Code Pink a parking space for protesting and a free sound permit was brought by council members Linda Maio and Max Anderson.

Code Pink on Wednesday started circulating petitions to put a measure on the November ballot in Berkeley that would make it more difficult to open military recruiting offices near homes, parks, schools, churches libraries or health clinics. The group needs 5,000 signatures to make the ballot.

Even though the council items passed, not everyone is happy with the work of Code Pink. Some employees and owners of businesses near the Marines office have had enough of the group and its protests.

"My husband's business is right upstairs, and this (protesting) is bordering on harassment," Dori Schmidt told the council. "I hope this stops."

An employee of a nearby business who asked not to be identified said Wednesday the elderly Code Pink protesters are aggressive, take up parking spaces, block the sidewalk with their yoga moves, smoke in the doorways, and are noisy.

"Most of the people around here think they're a joke," the woman said.

Wozniak said he was opposed to giving Code Pink a parking space because it favors free speech rights of one group over another.

"There's a line between protesting and harassing, and that concerns me," Wozniak said. "It looks like we are showing favoritism. We have to respect the other side, and not abuse their rights. This is not good policy."

Ninety-year-old Fran Rachel, a Code Pink protester who spoke at the council meeting, said the group's request for a parking space and noise permit was especially important because the Marines are recruiting soldiers who may die in an unjust war.

"This is very serious," Rachel said. "This isn't a game; it's mass murder. There's a sickness of silence of people not speaking out against the war. We have to do this."

Anderson, a former Marine who said he was "drummed out" of the corps when he took a stand against the Vietnam War, said he'd love to see the Marines high tale it out of town.

"We are confronted with an organization that can spend billions of dollars on propaganda," Anderson said. "This is not Okinawa here; we're involved in a naked act of aggression. If we can provide a space for ordinary people to express themselves against this kind of barbarity, then we should be doing it."

One more reason to love Berkeley.

But, right now my favorite town is that one in Vermont, who is drafting a resolution to arrest and charge Bush and Cheney with war crimes. :)

So apparently Code Pink and Berkley are opposed to free speech, freedom to assemble and freedom of choice. Just imagine if a city council banned Code Pink from their city. How do you think Code Pink would react?

Berkeley, supposedly the home of "free speech" in the '60's.

Was the Marine Corp recruiting station banned, or was their “freedom of speech” revoked?

No it wasn’t. You just made that up. The City Council wrote the Corps a letter, stating their recruiting efforts weren’t welcome downtown. For reasons stated in the resolution. Reasons that I think are valid, though I’m sure others disagree. They weren’t banned, nor was their recruiting station shut down.

And the City Council directed the City Attorney to explore options for enforcing the City's Municipal Code which prohibits discriminatory practices on the basis of sexual orientation. The Marine Corps will not hire openly homosexual Americans, and will discharge them if they admit they are homosexual. That's blatant discrimination, IMO.

That’s all that happened. They didn’t infringe anyone’s rights. They expressed their opposition to the war and military recruiting for that war on City of Berkley public property. Got a problem with that? That’s freedom of speech TOO.

As for the legal aspect of enforcing the Municipal Code on non-discrimination practices, the City has a right to do that. That’s why we have courts. This is America, you can take your case to court you know. They’ll probably be shot down. But, they have every right to exercise their right to petition the government – in this case, the courts. That’s a right too, you know.

I lived next to Berkeley for 10 years and in the Bay Area for 25 years. I know all about Berkeley and it is quite possibly the most politically correct place on the planet. So yeah, the Marines didn't have any legal violations done to them but the attitude they were shown has been shown year after year in that city.

Oops, sorry, cawacko, I didn't realize this thread was about the Marines in Berkeley when I posted the article a little later in another thread. I'll delete mine.

In the spirit of tolerance and getting along, may I offer a modest proposal to remedy Berkeley's problem with the Marines?

All the Marines need to give up their U.S. citizenship, and move to Mexico.

Then they can walk across the border some dark night, evade all the Federal guards, Minutemen, etc., pile 18 at a time into 8-passenger vans, toss in a few kees of pot for good measure, run over and kill a few Border Patrol agents. Then they can make their way up to Berkeley as illegal immigrants, drving at high speeds and knocking other cars off the road as they go.

They'll be welcomed with open arms.

Problem solved.

Imagine the complete ingratitude to tell someone that they aren't welcome in your town when they are the very ones that protect your right to say it. The very organization that is willing to put their lives on the line for the rest of us... yeah, they shouldn't be welcome.

Code pink can rot in hell. They are pathetic. As is the Berkley council.

Is someone about to invade berkley? Answer! No
Its one of the most liberal cities. Had we not missed used our military in a ghestapo fasion they likely would be welcome. Instead of peacekeepers and protectors the republicans treat the military as a machine that needs kills on a regular basis.

If you can't spell "Gestapo" you don't get to talk about them.

Lefties don't think shit like this through. And then they wonder why it is moderate america ends up voting for conservatives. This is why I moved to the center and away from liberal politics. This is the STUPIDEST thing I have read all day and I have read some stupid shit. They are JUST Marine recruiters doing a job and providing a place for young men and women to enlist in the Marine Corp. They are going to enlist anyway. When lefties do shit like this no one takes them seriously about any other issues they may have something to add to. IDIOTS

Very true. Its picking stupid battles, that's why I left the Libertarian Party, because they with this stupid. After a school shooting in upstate NY, there's some asshole from the LP hanging around the school handing out cap guns. I don't remember the details, but I remember it was a stupid time and place to be pushing gun rights shit, and it sent them backwards instead of forward, as usual.

This is a conversation. You KNEW what he meant so don't be a spelling Nazee.

Thats why I told him to STFU. Try to keep up.

Because it was the Marines fault they were sent to Iraq? Because the Dems haven't sent them to war? Vietnam? Bosnia? Serbia? Iraq? (yes, despite their claims of ignorance... many Dems voted to authorize force then proclaimed they were tricked.... funny, because the idiot Bush then tricked them again with the Iran vote)
