Trump is pushing this to the Supreme Court for a decision, as he should. Of course, the Supreme Court will decide this based on precedent, and it has already been decided in United States v. Wong Kim Ark. Trump is exploring a "slavery" angle, but this will go nowhere, as the clause "and subject to the jurisdiction thereof" was decided back at the tail end of the 19th century.
