I never stated it was just an investigation on law enforcement. I stated, quite clearly, that they are investigating the racial component of the situation. That will include whether or not Zimmerman's killing of Martin was racially motivated (ie... Zimmerman was a racist) and whether or not the local law enforcement acted based on racial lines.

Actually you can arrest someone based on suspicion. Given that Zimmerman shot Martin, admitted he shot Martin... there was definitely enough to hold him on for at least 48 hours. At which time they would have to decide to charge him or not.
