Nope. The jury was free to convict on 2nd or 3rd degree, and even manslaughter, according to the news reports I have read. So the premeditation excuse doesn't float.

Played a role in the crime? I have no doubt of that. Played a role in the Jury verdict? I don't know, I don't discount that at all, I just don't know it for a fact and I'm willing to give the jury the benefit of the doubt. My understanding is that the Jury was dead locked on whether it was Murder 1 or Murder 2 or Manslaughter but not the fact that he had committed one of these three crimes. Therefore I'm don't think race played as much a role in the verdict as you may think.
 
NY Times says Murder 2, murder 3, and manslaughter are automatically included. They didn't have to vote 1st degree. I am not a lawyer and I know news reports can be wrong, so if I find out different I will say okay. As things stand, nope. That wasn't the problem.
We're aware of that Darla. What were saying is that the Jury was hung on which one of those to convict him on, not the fact that he was guilty of one of those...just which one.
 
BTW he can be retried for murder, he wasn't found not guilty, so we'll see. Also, three counts of attempted murder the judge will hopefully put him away for what amounts to life anyway. But this isn't cool to me anyway. I believe my read is correct, and we all are just voicing opinions. Mine makes sense to me. A lot of sense.

Have yet to see a plausable theory on why he's guilty of 3 counts of attempted murder, but not guilty on any degree of murder for the guy he actually hit? If you take murder 1 out of it, anyone got anything?
Again, my understanding is that the Jury wasn't hung on the issue of his being guilty. It was hung on the issue of "was he guilty of Murder 1 or Murder 2 or Manslaughter?" and that they could not agree as to which of these he was guilty off.

The counts are consecutive with a twenty year minimum, with a max of 15 for the firing missile charge. So even before count one this guy is facing a minimum of 60-75 years in prison which is life obv
Florida has what's called a 10-20-Life law. Under that sentencing law Dunn is eligible for 25 to life just for the attempted murder convictions since his conviction meets the aggravating circumstances of the 10-20-Life law.

Sentencing in Florida for this conviction, because it involved a firearm, is 100%. No early release. If he gets the minimum 25 years he has to serve 25 years, no good behavior time off. Technically speaking Florida does not have parole. Under Florida truth in sentencing laws a convict must serve at least 85% of their sentence. They can achieve gain time that would reduce their sentence by 15% if eligible. Under Florida's firearms law it doesn't appear that he is eligible and would have to serve 100% of his sentence. If he's given a life sentence he also would not be eligible for early release and would have to serve life in prison.

Nope. Two black women are not voting not guilty on this guy. I will tell you what is far more likely to be going on. They reached guilty on the first four charges, one of which was firing a gun into a car (duh), but there are about two or three white people who feel sorry for him because he looks like their dad, and are loathe to send him away for life.

If they don't cave, the jury will hang, the black women will hold firm. Do you know why? THAT COULD BE THEIR FUCKING SON.

That's my understanding. That they thought he was guilty but couldn't decide between murder 1 and murder 2.

at the end of the day though we are just guessing. they very well could have believed he was right to initially fire in self defense but once the car was driving away he was no longer in imminent danger and thus the attempted murder charges.

Hence the question:

If we determine deadly force is justified against one person, is it justified for the others?

why would the jury ask that question unless they are thinking that at least one person may have had justified deadly force against them?
 
Mmmm the fact that he'll be going to prison for 25 to life regardless of the Murder verdict is just. I still think he deserves a murder 2 conviction.

dude, it's going to be 60+. the sentences will be consecutive. i forget where I heard that but I've read/heard it in multiple places. he's in for life.

yeah but that's moot as the attempted murder charges carry a 20 sentence minimum and they are going to be run consecutively.

And don't forget in the world of "states' rights" and without any national lynch law, the lynching of black males is still legal in many areas of the South, and especially in Florida where recent changes in the law of self-defense mean that as a white male with a gun for protection I can indiscriminately shoot as many times as I want or even empty that gun into a car full of black faces and claim I was terrified that they were coming to get me and slide on murder charges if I just happen to kill any of them, no matter how racist I am or what they find out about me on the internet. And I can claim that I am not a racist and that I am just generally scared of black people and black cats and black anything. And isn't it great to live in a country like that, where white privilege still means something, by gawd.

This bastard will probably be out on appeal of the verdict in less than a month.
