Will Trump be Reelected via Electoral College or via 12th Amendment ?

The Constitution thinks they are "votes."
The Constitution does not think. It is a piece of paper with words on it. Sorry to break to ya, but it has no brain.
When you cast a ballot and count them that constitutes an (electoral) vote.
That happens Jan 6th.
If states change their mind it is too late.
They can change their mind right up until Jan 6th.
States have already delegated that power to the voters of the state.
They can't. The Constitution has not been amended by the States.
"...they shall name in their ballots the person voted for as President, and in distinct ballots the person voted for as Vice-President, and they shall make distinct lists of all persons voted for as President, and of all persons voted for as Vice-President, and of the number of votes for each, which lists they shall sign and certify, and transmit sealed to the seat of the government of the United States, directed to the President of the Senate;..."
Contextomy fallacy.
The Constitution refers to "ballots" and "votes" and the "number of votes for each." So, yes, the electoral college has voted.
No, it hasn't. That takes place on Jan 6th.

you are too stupid to argue with. good god. do you really believe ignoring reality is a good way to debate? you are a silly person.

Inversion fallacy. It is YOU that is ignoring reality. Jan 6th is in the future, not the past. Are you using a different calendar than most people in the United States? What year is it on your calendar? Mine is currently 20.12.29.t.0356pst. Jan 6th, 2021 hasn't happened yet on my calendar.

moving goalposts again? first it was, just wait till the trump lawsuits hit the courts!! then, just wait till the states have recounts! then just wait till a trump lawsuit makes it to the Supreme Court! then, just wait until the Electoral College votes!! now just wait until January 6. it is over. you are a clown. NEXT!

you are posting while on opioids you really need to seek therapy you're saying some really stupid crap

No such requirement. State legislatures can change their electors right up until Jan 6th.

'Expert' worship. False authority fallacy.

You deny it.

The United States is not and never was a democracy.

False authority fallacy.

There is no such requirement in the Constitution. The federal government has no authority to dictate how State legislatures choose their electors.

No such requirement.

False authority fallacy.

The Constitution, and ONLY the Constitution is the authoritative reference of the Constitution.

The only false authority is your views on the Constitution which go against established principle and law.

Do you think any states will change their electoral votes before January 6?

We already have. You are greatly confused and seem to be beyond help. I agree with IBD. This is not the first time you have denied the Constitution.

We already have seen what?

You agree with IBD? I thought you were IBD and SmarterthanYou. You three are the only ones with the perverted constitutional views denying its basic provisions.

LOL, yes, he agrees with himself. Not even a particularly good effort at a sock.

There are no electors present at the joint session of Congress on January 6. The electoral college voted on Dec 14 when electors actually met, voted, and counted and certified those votes. Read the Constitution.

The Constitution has no date. Congress has no authority to take away a State's power over it's electors.

"The Congress may determine the Time of chusing the Electors, and the Day on which they shall give their Votes; which Day shall be the same throughout the United States."

Congress has the plenary power to determine the date for choosing electors. States have no power to take away the constitutional power of Congress. After states have exercised their constitutional duty to determine how electors are chosen Congress determines when those states will meet and electors vote.

These are two separate powers and each has constitutional authority.

Which states have filed contested and where is the constitutional power to do so? What is the relevance of filing contested? Nothing.

A week from tomorrow, we will all assemble here in this thread and laugh our asses off at IBD, ITN, Stoney and Stretch. Should be fun.

The electors gave their certified votes in an envelope to the Senate archivist. The voting is done. All they do is a formality of counting them. in Jan.. It is over.

They will tell us it is not over yet. The Supreme Court will save the day.

They have had about ten bites at that rotten to the core apple. They don't get another one. But yes, they'll come up with some new and bizarre legal theory. Because they can't accept that their guy lost. Hugely. Sad really.

Yes, it seems simple (unless we are overlooking some mysterious fallacy).

If the electoral college does not meet until January 6 that is claiming the electoral college meets without any electors being present.

That makes no sense. The Supremes want no part of this clusterfuck. It is over.

I favored the appointment of conservative Supreme Court Justices and when we got exactly what we wanted by interpreting the Constitution based on the text, conservatives are complaining because the Justices are not being activist.

The original jurisdiction of the Constitution is for disputes between states (boundaries, etc.) and they object because Texas citizens can't interfere in the rights of the states to administer their own elections.

Agreed. It was a stupid attack on the Constitution's Tenth Amendment.

moving goalposts again?
Nope. Doublespeak. Fallacy fallacy.
first it was, just wait till the trump lawsuits hit the courts!!
They are still in the courts.
then, just wait till the states have recounts!
Recounting fake ballots is meaningless.
then just wait till a trump lawsuit makes it to the Supreme Court!
One still is in the Supreme Court. The one filed by Texas (not Trump) has been ruled upon (badly).
then, just wait until the Electoral College votes!!
You're gonna have to at least wait for that.
now just wait until January 6.
That's when the electoral college votes.
it is over.
You are still confused. Jan 6th is in the future, not the past.
you are a clown.
Thank you. I never studied to be a clown. I'm glad you think I'm good at this entertainment medium.
Next what? After Jan 6th? That rather depends on what happens Jan 6th.

If, as I suspect, there not be a valid Majority in the electoral college (currently 207), then the vote will go to the House, with each State getting one vote. Under that scenario, Trump will quite probably win. That takes place after Jan 6th, if it happens.
Since at least seven States have filed Contested, the require Majority in the electoral college will probably not be attained by either party.

Of course, it's also quite possible that these seven State legislatures will simply choose the Republican slate of electors they designated, thus achieving the required 270 votes. In that scenario, Trump wins. So far, these legislatures are leaning Republican, but have not decided yet.
