Yes, they say that, but they have to say that, to try and insure people that they are still going to be fare in their judgement in spite of it.
But that is not how juries think! They are not as smart as the judge in these matters.
Trust me, Judges and Juries are offended when someone fails to show up to their court! They showed up!

I hope Trump does sue her. It means he would have to testify under oath. He would be deposed again under oath. He would have to testify at the trial. All of his statements could be used against him when he is on the stand. All the statements he made under oath in this case could be used against him. This time Trump could be forced to provide DNA to see if it matched what is on the dress Carroll claims to have saved. In this trial Carroll had the job to prove her case with the preponderance of evidence. She wasn't able to meet that when it came to the rape charge. That doesn't mean she was lying. It only means she couldn't prove it to the jury.
Ms Carroll lives in NY. If he files in any state other than NY, the case will be tried in Federal court under federal rules. Trump would be forced to prove with the preponderance of evidence that he didn't rape Carroll. That means if the jury has a 50% belief that Trump raped Carroll, he would lose the case. The only thing the case would be arguing over is when sexual battery becomes rape since we already know he sexually assaulted her.
This wasn't a criminal trial. There is no fifth amendment right. The jury is free to assume not testifying is sign of guilt in a civil trial.
