Trump vows to end birthright citizenship for children of immigrants in US illegally

Donald Trump said on Tuesday that if elected president again in 2024 he would seek to end automatic citizenship for children born in the United States to immigrants in the country illegally, a plan that contradicts how a 19th century amendment to the U.S. Constitution long has been interpreted.

Trump, the frontrunner for the Republican presidential nomination in an increasingly crowded field of candidates, said in a campaign video posted to Twitter that he would issue an executive order instructing federal agencies to stop what is known as birthright citizenship. Any such action by Trump would be certain to draw a legal challenge..............

Native American Indians born in the US or on a reservation did not have US citizenship until the Snyder Act was passed in 1929. If an Native American Indians wasn't a citizen then someone born in the US with no American parents are not US citizens either. This issue has never been fully litigated at the Supreme Court. It is time the issue is litigated in the Supreme Court.

That would be a phenomenal thing for the US.

this is settled law.

Unless you are a Native American or a foreign diplomat - you live under the jurisdiction of the United States and have citizenship at birth

a President is not the king, he does not have the power to overrule an amendment just as Biden can't demand the debt ceiling is raised

Please explain how trump is planning to over ride the constitution, which grants citizenship to any person born on our soil. This is just more trump BS where he talks first and then blames others cause he couldn't get it done.

No depths to which he and his wannabe imitators won't sink to appease the lowest rung of society.

Read the SC Elk Vs Wilkinss decision.
https://en.wikipedia.org/wiki/Elk_v._Wilkins

Even though Elk was born within the territorial jurisdiction of the United States, he was born as a subject of an Indian nation, and thus could not meet the allegiance test of the jurisdictional phrase because he "owed immediate allegiance to" his tribe, a vassal or quasi-nation, not to the United States. The Court held Elk was not "subject to the jurisdiction" of the United States at birth. "The evident meaning of these last words is, not merely subject in some respect or degree to the jurisdiction of the United States, but completely subject to their political jurisdiction, and owing them direct and immediate allegiance."

Did the SC mean Elk could go around killing people because he wasn't subject to our laws?

Are you sure? I think dual citizenship.
Nope

A person born in the United States to a foreign diplomatic officer accredited to the United States is not subject to the jurisdiction of United States law. Therefore, that person cannot be considered a U.S. citizen at birth under the 14th Amendment to the United States Constitution.

In a 7–2 decision, the Supreme Court ruled that even though Elk was born in the United States, he was not a citizen because he owed allegiance to his tribe when he was born rather than to the United States, and therefore was not subject to the jurisdiction of the United States when he was born.

Any body under our jurisdiction is subject to our draft in time of national emergency. Illegals are subject to their country not ours.

so you honestly feel that illegal aliens are not subject to our laws?

They can steal, rape, and murder and we just have to let it happen?

Your draft reply is nonsense - we wouldn't trust them in our army anyway - it is moot

So now Trump is going to change the Constitution? I thought MAGA took the Constitution as reverent, that it couldn’t be changed?

Just like the Wall, remember the one Mexico was a going to pay for, a Trump promise six years ago that he never fulfilled, or even came close to fulfilling.

And are you aware that refugees are not illegals?

Trump doesn't give a shit about the constitution.

HAHAHAHAHAHEHEHEHEHOOHOOHOO!

This is how Donald Trump would handle the DACA children huh?

By violating the Constitution?

NO SIR! I DON'T THINK SO!

Donald Trump will never be allowed on the White House grounds ever again!

He'll be lucky if he ever gets to vote again legally!

It won't be long and Donald Trump will have to be wearing a soap-on-a-roap in the shower!
