Trump doesn't have immunity for 2020 election reversal efforts

Donald Trump is not immune from prosecution for alleged crimes he committed during his presidency to reverse the 2020 election results, a federal appeals court said Tuesday.

The ruling is a major blow to Trump’s key defense thus far in the federal election subversion case brought against him by special counsel Jack Smith. The former president had argued that the conduct Smith charged him over was part of his official duties as president and therefore shield him from criminal liability.

“For the purpose of this criminal case, former President Trump has become citizen Trump, with all of the defenses of any other criminal defendant. But any executive immunity that may have protected him while he served as President no longer protects him against this prosecution,” the court wrote.

The ruling from the three-judge panel was unanimous. The three-judge panel who issued the ruling Tuesday includes two judges, J. Michelle Childs and Florence Pan, who were appointed by Joe Biden and one, Karen LeCraft Henderson, who was appointed by George H.W. Bush.

Trump’s team could appeal the ruling directly to the Supreme Court, or first ask for en banc review at the appeals court, meaning the case would be heard again, but this time by the full DC Circuit.

Everyone knows this will go to the Supreme Court. Trump's lawyers will likely ask for a in bank decision from the entire appeals court. That will delay things even more. Then this will go to SCOTUS.

Why does an innocent man want so many delays? I’d want to go to court to prove my innocence, get it out of the way, save lawyer fees, but I guess when it’s other people’s money, you just don’t care!

If Trump’s lawyers use the same argument, he will lose, again.

His schedule is a little busy trouncing Joe Biden and Nikki Haley right now.

Why did Nixon have to be pardoned by Ford?

It was unanimous. Trump had no case. Why it took a month I cannot imagine. Trump was going to destroy the separation of powers by making the president immune from the law.

The Judges that heard his argument were all Democrats nominated by Democrats. Don't get your hopes up Joe.
Melania, you are wrong, again.

Oooops!

I hope US District Judge Tanya Chutkan can now keep the March 4th trial date on the obstruction case?!! Over sixty percent of Americans want this trial settled before the election?!! This trial has a bearing on the outcome 2024 election too?!!

If Trump is found guilty on the obstruction case, will the GOP run a convicted felon as their standard bearer? Is Nikki Haley hanging in the balance?

No, they were not. And, it was a legal decision, not political. Trump had no case. Why they took so long to do it is bothersome.
The reds went after Clinton and the same logic nailed daffy Donald. Bill was not immune from prosecution. That made reds happy. Now Trump is not and they are sad,.

Yup, and the Supreme will deny Trumps delay tactics. The fact that you fuckers will support a man who argues for an all powerful dictator president is sick.

Trump will ask for en banc review and it will be rejected.

Trump will then ask the SC to review and that will be rejected.

You will say no, and you will be wrong on both.

She cannot and has already stated as much.

The amount of weeks this has spent up to now, and until all reviews are done will be added o the March 4th date. Meaning if all these appeals wind up within 2 months, we are looking at May4th.

She will not risk Trump's due process rights and giving him a strong case to get it over turned on appeal by not giving him sufficient time to defend himself.

Nope  Presidents have to have immunity so the SC needs to decide the issue.
