Smith is just recognizing this reality, however Smith’s appeal to the Court states clearly that he doesn’t not admonish the charges and that he purposely filed the appeal “without prejudice,” meaning it could be reopened in the future

DOJ policy is to not indict unless there is enough evidence that a conviction is possible. That policy won't change and judges don't take kindly to prosecutors that violate that policy or the Constitution.

How is that relevant? I didn't say go arresting people willy nilly but don't worry it won't take long to have enough evidence once the people hiding it and covering for the criminals are gone.
