So the District of Virginia has a unique law that would allow the Comey case to be brought again within a 6 month time window. If a case was brought properly before the Statute ran out, and then kicked for technical reasons and the Statute of limitations lapses, they give 6 month exception to refile.
But and this is important, the Trump admin is between a rock and a hard place because to do that, would mean not appealing that the US Attorney was 'improperly put in office' and Trump and his admin have 4 other such US attorneys in place like that and they have been fighting to keep them in place while giving a middle finger to the law, hoping the SC will eventually let them do this and grant this power to the POTUS and take it from Congress (the need to 'affirm').
So if Trump and Co do not appeal they will lose on the Appointment piece, and if they do Appeal, the Statute would run out, including the 6 month exception and they would be all in on the need to win that 'appointments' case and thus over turn this ruling.
