Federal judge dismissed indictments against Letitia James and James Comey

So the District of Virginia has a unique law that would allow the Comey case to be brought again within a 6 month time window. If a case was brought properly before the Statute ran out, and then kicked for technical reasons and the Statute of limitations lapses, they give 6 month exception to refile.

But and this is important, the Trump admin is between a rock and a hard place because to do that, would mean not appealing that the US Attorney was 'improperly put in office' and Trump and his admin have 4 other such US attorneys in place like that and they have been fighting to keep them in place while giving a middle finger to the law, hoping the SC will eventually let them do this and grant this power to the POTUS and take it from Congress (the need to 'affirm').

So if Trump and Co do not appeal they will lose on the Appointment piece, and if they do Appeal, the Statute would run out, including the 6 month exception and they would be all in on the need to win that 'appointments' case and thus over turn this ruling.

^ re my above post it gets worse for Magats.

It is the Judges in the distict now who will choose the Interim US Attorney up and until Trump nominates one who gets confirmed.

It is that new US attorney, appointed by the judges who will decide the appeal. That person may have zero loyalty to Trump or Bondi and will not be forced to follow any instruction from them.

And another interesting point about the above is the way the Judge crafted the order relying on Eileen Canons ruling dismissing Jack Smith, which means if the Trump team does appeal this and win, it then proves Eileen Canon ruling, that NO legal experts agreed with, just sitting their unchallenged by the Trump DoJ, is actually invalid.

She has forced their hand to take that on, when she did not have to, if they want to appeal this.

“…At a press conference in Memphis, Tennessee, on Monday announcing anti-crime efforts there, Bondi said the Justice Department would take an “immediate appeal” of the judge’s rulings and also pursue “all available legal action.” She did not elaborate.

Any appeal, which would go to the Richmond, Virginia-based 4th Circuit Court of Appeals, could mean a delay for any attempt to re-indict Comey or James.

When Halligan raced to indict Comey just three days after Bondi appointed herat Trump’s urging, it was to beat a Sept. 30 statute of limitations that would have prevented her from indicting him at all.

Currie’s dismissal of the case, however, may have triggered a law that provides a six-month period for the Justice Department to try again, even after the statute of limitations expired…”

So much for Trumpian justice.

The judge found that the appointment of interim US Attorney Lindsey Halligan in Alexandria, Virginia, was invalid.

Trump handpicked Halligan for the role amid increasing pressure to bring criminal cases against his political enemies, including Comey and James.

You left out the part that she was only "handpicked" after several other career prosecutors either quit or were fired for refusing to prosecute the case.

It's all about harassment and intimidation. Authoritarian tactics all.

Excellent news. It was all bogus bullshit anyways. Just more of the #Weakling-in-Chief's 2025 Vengeance Tour failures.
