In 2006, when Bush was President, he used his marriage, and legal status to get a Green Card, or permanent residency. At that point, he was permanent legal status. Seven years later, he got citizenship.

Throw in that he originally entered the US illegally (tourist visa overstay).

He entered the USA legally, on a tourist visa, and then applied for other visas, so no overstay.

It appears he had a semi-automatic and that was probably obtained illegally given his criminal record.

Diagne had no felonies, and lived in Texas, which meant it would be easy for him to legally buy a gun.

There is absolutely no evidence he overstayed his visa. Diagne appears to have either had a visa, or had a valid application in for a visa at all times. the trump administration is desperate to paint Diagne as an illegal immigrant, but has failed to prove that he was an illegal immigrant. That makes me think that he had an application for a visa in before each deadline.
