4 ways to change the constitution.

"There are actually four ways. (1) Both houses propose an amendment with a two-thirds vote, and three-fourths of the state legislatures approve. Twenty-six of the 27 amendments were approved in this manner. (2) Both houses propose an amendment with a two-thirds vote, and three-fourths of the states approve the amendment via ratifying*conventions. Only the 21st Amendment, which repealed Prohibition, was passed in this manner. (3) Two-thirds of the state legislatures call on Congress to hold a constitutional convention, and three-fourths of the state legislatures approve the amendment. (4) Two-thirds of the state legislatures call on Congress to hold a constitutional convention, and three-fourths of the states approve the amendment *via ratifying conventions."

Is this to hard to understand?

Far easier just to ignore it and pass any law they want. Both parties have been doing that for over a century.

A constitutional convention can take place without Congress.

What part of Two-thirds of the state legislatures call on Congress to hold a constitutional convention, don't you understand?

You are either a troll or the stupidest person at JPP. My vote is both.

They can, but they don't have to.

Congress is not necessary to change the Constitution. Neither do they have any authority to.

Congress is involved in some form or fashion according to the Constitution.

They do not have to be, though they usually are. They do not have the authority to change the Constitution. Only the States have that authority, collectively. The States (Colonies) ordained the Constitution to power. It is like a contract between the States, and one of it's main purposes was to form a new layer of government to handle certain affairs between the States and to provide for a common defense. The new government was given specific enumerated powers. It has no other powers.

It is quite possible for the States to meet outside of Congress and completely replace that Constitution if they wish. If they were to do so, and ordain that new constitution to power, the old constitution would be utterly rejected. It would no longer exist as a force of law, and the government it creates would no longer exist as a government.

Not likely, to be sure, but it IS possible.

Congress has trouble agreeing to anything but a raise for Congress.
But interesting anyways.

The United States are no longer sufficiently functional as a union to amend the constitution.

We are a nation of people who genuinely and sincerely despise one another.

Anybody who claims to be a vessel of unity is a blatant fraud.

Believe the people who clearly take a side.

Even the Conservatives and the Evangelicals, as twisted as they may be, are at least sincere in their espousal of their despicable values.

The ones who say that they can "bring us together" are spreading shit with a T-shirt cannon.

Not according to the Constitution itself.

Sure it is.
We are a nation of people who genuinely and sincerely despise one another.
Always have been.
Anybody who claims to be a vessel of unity is a blatant fraud.
Nobody ever did.
Believe the people who clearly take a side.
Why?
Even the Conservatives and the Evangelicals, as twisted as they may be, are at least sincere in their espousal of their despicable values.
Conservatives are not despicable values. The constitution that they desire to conserve is not despicable.
Evangelists are not in and of themselves despicable. They are just out there telling the world about their religion (whatever it is). That's what an evangelist is...a missionary. No one is forcing to you believe their religion (whatever it happens to be).

Not according to the Constitution itself.

If Congress is not used to form a constitutional convention, it goes around the constitution. It's out to replace it. The same authority the formed the original constitution would form its replacement. In such a case, the federal government would simply cease to exist as a government. The replacement constitution would again be a contract between the States, and would again form a government and describe its powers. It would be a completely new government. The federal government would be no more if such a constitution were constructed by the States and ordained to power.

The States ordained the original Constitution to power. They have the full authority they need to remove it from power and replace it with a new constitution. No Congress necessary in that case. This wouldn't be an amendment, it would be a replacement.

To amend the current constitution, yes, Congress does get involved. However, even then, they do not have authority to amend the constitution...only propose an amendment to the States. Only the States can amend the constitution.

Your post should be in the conspiracy theory section.

Nothing despicable about wanting to retain the values of the founders, boy.

Anyone that wants to turn this country onto Socialism should be treated as a traitor.

Just pass an amendment that the Constitution is suspended when A Repub wins the presidency and stays that way until a Dem gets back in the office. At least that would serve reality.

Inversion fallacy. It is the Democrats that want to destroy the Constitution.
