What time of day was it that he was asleep in the Taco Bell drive thru with a gun in his lap.. and why didn't he wake up when they tried to open his cardoor or when they moved police cars in front and in back to block a possible escape?

It sounds to me like a horrible mistake, however, that's no reason to claim it was deliberate or that the police wanted to kill him.
