He’s a genius at evicting tenants who are late on their rent, but that’s about it. This kind of law practice has very little to do with the law. It’s a paperwork practice and possibly a few court appearances where you show the judge where the right paperwork was filed.

It’s been 40 years since, I suspect, he muddled through some law classes, likely cheating in order to get a Barely passing grade at a 3 rate school.

And i say this part seriously. Just imagine trying to hire PmP for any serious issue you had in law in any area of law, and how much trouble he would get you in with his piss poor understanding of law and mistakes, but strongly pushed opinions. You would get smashed in court.

It is the trap of falling into the Trump cult and becoming an ideologue.

You see two clear divisions in the lawyers who go to work for Trump. Those who see there simply is no defense available to Trump, without tipping into legally unethical territory and lawlessness, who end up firing Trump as a client and walking away and those who stay, and are forced into unethical territory and lawlessness and we see many of them facing disbarment and/or jail.

PmP falls into the latter group. Because of his NEED to always defend Trump, it leaves him no path but to accept the most stupid, and obviously wrong legal opinions.

to his credit it is very easy though to get him to backpedal away from him. He is willing to google when you correct him. It is just constant. That is why i encourage him, and you can now see him asking me above, to educate him first, while he holds back his opinion, so as to not make more embarrassing mistakes.

Now the ACLU is agreeing the gag order on Trump is not Constitutional.

The ACLU is not saying a gag order on Trump is unconstitutional. It is completely constitutional to enact one.

The ACLU is merely arguing they see this as too broad and that it needs to be more specific just so he knows more clearly what he can and cannot say. And even the judges admit they must narrowly craft these to keep them relevant to the cases and not to otherwise block speech. So these are opinions that would get debated and ultimately appealed to superior courts to decide the lines.

Maybe Georgia is different, but generally a judge is empowered to revoke bond status at any time.

in Michigan they hold hearings on matters like that.....scheduled on a motion filed by the prosecutor. I'm sure the state of Georgia does the same for defendants not subject to kangeroo courts...

Neither groups nor individuals determine the constitutionality of anything.

(I want you to read that again 3 times)

What they are offering is their OPINION it might be Unconstitutional as they think it is too broad.

This is a legit question all the courts are wrestling with as they balance protecting their courts, their staff, and the court proceeding while ALSO making sure they do not impinge on Trumps OTHER free speech rights.

Another court, the Appeals Court will make that decision that the ACLU CANNOT make despite you, being a lawyer, thinking they can.

Now run off and google the question of 'who can declare Constitutionality' and come back and backpedal more.

I think that such gag orders are indeed constitutionally iffy.

I'm just not a particular admirer of the constitution.

They are iffy and even the Courts and Judges admit that.

it is a balancing act that Courts have to try and do to protect the Court process, because a convicted person can win an appeal based on 'prejudicial things being said in public that may have impacted a jury' and other reasons but then also allowing the person to speak with his 1st amendment rights.

With a person like Trump, he is almost always going to end up at the Appeals court because if he is given no limits and free reign he will terrorize court staff, witnesses and jurors. Impose even modest limits and he will constantly push them until they end up in Appeals Court.

And while i generally think appeals courts are very likely to side with first amendment rights, i think Trump loses here. And that is because Courts and Judges like power and to not give it away. Trump would be arguing to the Appeals court to make it easier for defendants to cause problems in the court, and to weaken the hand judges have to control that, including the Appeals courts. I do not think the appeals court will give away that power thus they will affirm Judge Chutkins sanction as a reasonable limitation.
