His lawyers have told the court he is willing to go to Costa Rica but the Trump DoJ has been fighting against that wanting it to be to some war torn country in Africa or one of their favored torture prison locations.
The DoJ is a joke. They stated prior how clearly guilty Abrego was and that he would NEVER return to America and if he did he would be tried and go to jail and then get deported.
They failed in every single regard. He is back in America and they refuse to take him to court as they know they would lose. they are fighting to keep him in America when he could be gone, as the sole goal they have is a punitive deportation.
A meaningless win that will make their magats clap like seals because at least it is deplorable and cruel, which is the best way to get to a magats heart.

Ever hear of a "bench trial?" Garcia got more than one hearing and more than one judgement against him. The documents prove it. Demanding he get a "trial," by which I assume you mean jury trial is a canard. That isn't necessary here for a final judgement to be rendered on his being in the US illegally.

Which prove he had his day in court, more than once, and lost. He is deportable. That was adjudged as the outcome more than once. The only question on the table right now is, where does he get deported to.

You do know that Garcia had an order of deportation on him prior to Trump taking office don't you? You do know that Garcia's lawyer(s) filed an asylum claim based on his fear of going to prison if deported to El Salvador. That too was denied but the Biden administration put a temporary stay on it. All Trump did initially was carry out the order of deportation.
Then Boasberg and Xinis got involved and have been losing one ruling after another on appeal. The process is a trainwreck only because the US judicial system has become one.
