Correct. Indians not taxed were not subject to US jurisdiction. That condition no longer exists. Per 1898 Supreme Court precedent (Wong Kim Ark) all children born in the US, regardless of the status of the parents, are US citizens, unless diplomatic jurisdiction is involved.
