BREAKING: Trump says he’s going to overturn the 14th Amendment with an executive order.

You are correct on the clarification, but I don't believe Trump will be able to end the birthright citizenship.

Correct.

... but their children, born in the US, are born in the US and subject to the jurisdiction thereof. Trump cannot alter this.

No one can be penalized for the crime of another, i.e. no child can be penalized for the crime of a parent.
It can be altered. Birthright citizenship was not decided by the Supreme Court until 30 years after the Amendment was ratified. Trump's Executive Orders can be challenged all the way to the Supreme Court. I'm very interested to see how this Court would decide the issue.

I accept your resignation. Let me know if you want to play again.

giphy.webp
Your sock would say that's an assumption of victory fallacy.

In the end, SCOTUS has to rule based on what is written in the Constitution. There is a process by which the States can alter the Constitution, but the Constitution cannot be altered by a SCOTUS ruling.

Until the States take up the torch of ending birthright citizenship, it will remain the law of the land. Neither POTUS, SCOTUS, nor POTUS-SCOTUS working in tandem can change this.

It would take at least 35 states to amend it, no? Do you think they could get them?

The point of contention is the clause about jurisdiction. The sole purpose of the 14th Amendment was to ensure full citizenship rights of ex-slaves and their descendants. Period.

I don't believe that the States are going to pick up that torch. There will be no change on this matter.

What will emerge is law that establishes how citizen children are to be treated when the illegal immigrant parents are facing deportation. You can't "deport" a US citizen, but you can either A) deport the parent and make the child a ward of the State or B) allow the illegal immigrant the right to speak for the child and to take the child with him/her, or C) something else. This official answer as to what is to be done is what will emerge from this kerfuffle.

OMG!!! OMG!!! Hair On Fire!!!

You commies and deviants should pack up and leave immediately, before it's too late. Any of you need a ride to the border or to an international airport let us know, we will be glad to help you on your way. You can go make North Korea or Somalia great again.
So dramatic. Silly.

Yes, and a simple Supreme Court ruling is all that is needed to point out the obvious original intent.

Democrats love judicial activism when it discriminates against real citizens.
