It could if it wasn't ruled that the Commerce clause applies and federal laws take precedence. They simply will not be allowed to package and sell an illegal substance, it won't matter what state laws they pass.

But the states don't have to help them out. That's a pretty big deal, Damo. You're acting as if all enforcement is by the feds, while a great part of it is by the state.

I think the feds would make a point of it, and they'd lose in court based on the ruling I spoke of before.

While the state could turn the other cheek so to speak they wouldn't be allowed to package and sell a Federally regulated illegal substance.
 
The states can't do anything about the federal regulation, but they're under no responsibility to help them out by keeping it illegal under their statutes. Of course the federal courts could do nothing about this law.

The point is to force the courts to rule on the state laws, which will create a media blitz and much attention to the issue. Besides, its high time the 10th Amendment got some attention.

knowing how our courts are, since the USSC decided Raich such a short time ago, unless some enterprising lawyer can come up with some sort of new and eye-opening argument, the courts will not visit the issue again for some time.

If the courts ignore the issue, then it means Cali can't be prosecuted for violating federal law.
 
stupid assed worthless gesture which will go nowhere. cannabis is, and will remain, illegal and untaxable until it is removed from the CSA. California will be stopped by federal courts the moment that they try to implement this.

without state cooperation the dea has to pour more and more resources into combating mj growing and distribution...what ever happened to the 10th amendment

taxing it is still cheaper than throwing people in jail and will likely have the side effect of saving our forests from mj growers that ruin whole stretches of state and federal forests and at a tax of $50 per oz. it would be cheaper and dealers would lose their incentives

as it is, selling mj for profit is becoming not very profitable

No. It just means you may feel fine in your open weed habits, and then one day a federal agent may send you to prison. It's really the state creating an unreal and dangerous sense of legality.

It is illegal based on Federal Law, so I dont belive this will work. The Feds would still preempt.
 
And like I said this is how you force it into the feds face. Its has to deal with the issue if a state has done this and is making bank.

In this atmosphere the feds will want their slice and so will all other states.

It would be great if the SCOTUS hadn't already set precedent on this and very recently. They'd be re-ruling on a previous ruling of the exact same court.

While I do believe that the Courts should be our best defense against the overstepping into States using the Commerce clause, it didn't work this time.
