The 10th Amendment clearly states that if it isn't spelled out in the Constitution as a federal power it is something the states or people have the right to do. Education and Housing and Urban Development are not functions of the federal government.

The powers not delegated to the United States by the Constitution, nor prohibited by it to the States, are reserved to the States respectively, or to the people.

So you're arguing that SCOTUS is non-partisan, but it clearly is partisan since 4 of the 6 Conservative justices were nominated by a Conservative who lost the popular vote, and 5 of the 6 Conservative justices were approved by Senators that represent less than half the population of the country.

And what if that "partisan bent" was the other way around? Would you still complain?

It does now. Public schools barely existed at the Founding if they existed at all. Anyway, it's a mistake to put education in the hands of politicians. Traditionally it's been left to educators and should remain that way.

If we elect good people it is not an issue.

The problem is people are so misinformed they don't know which way is up. Thanks to social media rumors.

And General Welfare is something Congress can legislate, and education is inarguably a part of the general welfare.

Yes, of course.

Unlike you, I am nothing if not consistent in my beliefs.

I believe the Supreme Court should be expanded to at least 15 justices, and the justices all serve terms between the circuit courts and the Supreme court.

So they rotate between the various courts, so that the SCOTUS composition is different for each cycle.

The 2nd was never intended to allow armed citizens to attack the government. It was intended so that we could quickly form an army to defend the nation. Remember, the Constitution said we would not have a standing army.

Now that we have a standing army and it is very well regulated so that we can trust it, perhaps we need to give the 2nd another look-see. It appears to be outdated and causing a lot of problems. Sandy Hook, Marjorie Stoneman Douglas, Columbine, Las Vegas, etc, etc, etc.
