That is not how the Special Counsel (SC) rules work.
I mean, that is how it worked when Barr was in charge as they ignored that the Prosecutor is supposed to do his work 'Independent' of the AG and then present his findings, along with his position on Indicting or not. At which point the AG either allows his position to stand (to indict or not indict) and go forward or the AG over rides it and forces the opposite. The AG over riding the 'independent' SC is considered pretty serious and as such that automatically triggers that congress get all the work, and findings of the SC so they can review it and understand why the AG is over riding the independent conclusions.
So Jack Smith will say to Garland "I have the following findings and it is my intention to file the following charges against Trump..."
AG Galand either stands in the way and steps in and stops it, or he allows Jack Smith to proceed.
Had Durham made any charging determinations and Garland over ridden him, we would all know. It would be a legit scandal for the GOP to highlight. But Durham did not. Garland let Durham already go and get embarrassed in court with a prior charge he tried to gin up, that they jury basically laughed out of court and Durham learned his lesson, that juries are not just republicunt partisans and he must ACTUALLY have a real case.
