Darned if I know. Cops get away with a lot of things that civilians don't. The police disciplinary units don't seem to think anything is too extreme (even the Amadou Diallo shooting!).

While I know cops are asked to go into dangerous situations where they have to make split second decisions (unlike a guy who leaves his gun lying around with the safety off so a 4 yr old kid can fire it), there are cases where either the cops are so incompetent, so racist, so careless of public safety that to me they should be charged, convicted and jailed.That they aren't I can only assume has to do with the politics around police disciplinary committees and the reluctance to convict their own.

Diallo's family eventually got a $3million settlement in a lawsuit. But the officers should have been jailed.

I've said all along if a child is injured in a gun accident the owner of the gun should face at least 10-20 years in prison.

When you statists start jailing cops for it, then maybe i'll agree to jailing civilians for it.

Is it just me? Are you saying that if a policemen accidentally hurts civilians during the course of duty, he should be subject to the same criminal proceedings as some loser meth-head leaving a loaded gun for his child to find? Is that what you are saying?
are we not all about equal protection under the law???? or do you prefer having better classes of citizens due to their jobs?

So there are many types of cop screwups:

1) Cop chases bad guy, kills civilian through shooting or car chase or something - accident. Probably cop should not be charged because it's part of their duties if the official investigation determines this

2) Cops shoot 115 bullets into a car, wounding civilians - there's something seriously wrong in that police dept; if the cops aren't charged, their superiors should be

3) Amadou Diallo shooting or Abner Louima torture - cops should be charged and jailed for brutality and murder

4) Cop at home, drops his gun, it discharges and hurts/kills someone - should be treated the same as a civilian who drops their gun

In the story STY posted, the discharge of the gun did not hurt anyone; the cop reported it promptly. I imagine in a civilian case, the civilian would not be charged with anything. Possibly in this case I could see suspending the cop for a few days because he should have known better how to store his gun.

We grant them greater leeway because they are forced to make split second decisions with lives hanging in the balance all the time.
 
Whenever I read about shit like this what makes me so goddamned angry and sad is that this little boy will now have to grow up without a dad and knowing that he killed him. How horrendously fucked up is that?
 
No she wasn't. She was voted out of office.

What is different though is that John Doe doesn't lose his livelihood for being an irresponsible gun owner.
the police chief was voted out of office, she did not lose her livelihood. she still has her law enforcement certification and can work for any police department in the state.

stop being obtuse about it. when a pilot or doctor makes a mistake, you idiots prosecute him for it, or at a minimum you revoke their license. you let the cop get away with it and let the city/county/state pay a settlement to the person who's rights were violated.
