What felony--and it would take a felony--did Perry commit and get charged with that would allow confiscation of his personal cell phone?

What possible reason does the FBI have to track down a member of Congress while traveling with his family on personal time, then demand he turn over to them his personal cellphone? They could have contacted his office or lawyer and requested this, but instead tracked him down and took it from him at a hotel.
