I had researched the topic before I even replied to your post. I do this for a living. I'm not questioning your motives but my point I was getting at was lets know what the facts are before we jump to conclusion. One of the facts is that this material that was spilled is not classified as toxic.

I saw a bathtub full of the water, I would not drink it or bathe in it!

It also has an LD50 of around 850 mg/kg. Slightly more toxic than dish soap. It's not corrosive, it's not ignitable, it's not radioactive, it's not an oxidizer, it's not classified as a marine pollutant, it's not toxic, nor does it carry any miscellaneous USEPA hazardous waste codes.

Having said that as more information is discovered per the investigations it appears this company has had a pretty bad history of a willful and negligent environmental record.

The fact that the chemical spilled is non hazardous does not mitigate their behavior. What if this has been benzene? You want to talk about an unmitigated disaster that would have been and this company does store chemicals far more hazardous than the one that was spilled. Not to mention their, what appears to be, willful negligence in this case contributed a large quantity of pollution to the Kanawa river and shut down the municipal water operations for 300,000 for close to a week. Lines that had to be repetitively purged to get rid of the chemical. Will they be held accountable for the economic cost due to that spill? I think that they should.

Sensible regulation means that you have reasonable standards for pollutants emitted outside of the plant, and reasonable penalties assessed when they are violated. It also means requiring a "belt and suspenders" approach to stored chemicals to contain the leak from a primary containment vessel. Monitoring and periodic inspections should be done by the state or its third party contractor, and paid for through permits issued to the plant.

This leak occurred because the secondary containment dike was not maintained properly. Whoever inspected it should be held liable.

is this a joke? This spill was because "Freedom Industries" hadn't inspected it since what, 1994 if I remember right? If you are going to hold that inspector accountable, then so be it.

I'll have you know this is a bigger lesson on freedom than I could ever teach.

Freedom in America is knowing that we will never have to worry about water like that. Not less regulation on coal industry for bigger profits. This topic is FULL of Irony.

How does one "enforce" regulations that have been "de-regulated".

I'm also a core Right Winger but I'm PROUD to say that I'm supporting the Left more today because they aren't spitting in the faces of everyone in America for profit. I don't think you know who I am vs what the idiots on here paint me to be. I think hard work should get hard pay. I think that if you are a part of a team that makes millions, you deserve your share, you were a part of that. Any small brain that misunderstands me is pathetic.

Freedom Industries Inc., facing multiple lawsuits and state and federal investigations after the Jan. 9 spill, filed a Chapter 11 petition with the U.S. Bankruptcy Court in the Southern District of West Virginia.

Company president Gary Southern signed the paperwork, which lists the company's assets and liabilities as a range - both between $1 million and $10 million. It says the company has at least 200 creditors and owes its top 20 creditors $3.66 million.

The water was tainted after a chemical used to clean coal leaked from a storage tank and then a containment area at a facility owned by Freedom Industries. The water ran into the Elk River, contaminating the state's largest water system.

The bankruptcy document says the leaky storage tank appears to have been pierced through its base by some sort of object. It also says a current theory for the hole is that a local water line that broke near the Charleston plant could have made the ground beneath the storage tank freeze in the cold days before the spill.

After the spill, residents in a nine-county area around the state capital of Charleston were told not to use the water for anything other than flushing toilets. Some businesses and schools were forced to close for several days. The water restrictions have since been lifted for most residents.

The terminal that leaked had not been inspected by state officials since 2001, when it was owned by a different company operating under more stringent rules. State officials said Freedom Industries bought the terminal last month.
