‘If you’re innocent, why are you taking the Fifth?’

It is not clear… you just claim I don’t understand. What do you think I’m wrong about?

You are backed into a corner and can’t get out so you make vague claims that I don’t understand and try to leave it at that!

It is clear to everyone but you. It started with you pretending it could be taken as guilt. Then when you agreed no lawyer should say it you used the "he did it first" argument of a four year old not realizing that it is a confession rather than an excuse.

Pretty much every action in the thread where you acted like Trump is the moment you made it clear you thought some rights only apply to folks you agree with.

I never said “it” could be taken as guilt.

A court can’t take “it” as guilt, but individuals are free to if they want. Knowing what I know, I am often inclined to take it as guilt in my mind.

It also flows from the 5th. Your right not to incriminate yourself is your right to silence.

You have a right to silence while in police custody, that’s Miranda not the 5th. You seem to believe one always has a right to silence, it’s not true.

Not directly, but you certainly inferred it. I chastised, you tried more excuses that were really confessions and finally landed on... Trump's a hypocrite! And I simply pointed.out that any lawyer implying guilt from silence would be chastised and possibly censured by the court. You continued to argue nonsense and try to infer guilt... waaay later you decided to pretend you never did because you were shamed into it.

‘If you’re innocent, why are you taking the Fifth?’ - Defeated Former President about to take the Fifth again!
You as a Lawyer should know Its a legal maneuver it does not infer guilt. Its been used by Democrats like Lois Lerner many time. So big deal councilor.

Now you got me reading the thread back to you when I said I wouldn't. I'll let it go from here. Say whatever makes you feel better about yourself. I learned a bunch about you in this thread, some of it was surprising to me.

Absolutely

You simply took an inference that was not there.

A lawyer is free to imply such guilt all day long outside of a courtroom if he so chooses. Last time I checked this id not a courtroom.

Nonetheless I did not say or imply such.

I often do, and I believe legitimately, infer guilt from someone pleading the fifth. That is different from inferring guilt from someone remaining silent while in police custody. You simply misunderstand the complexities of this issue and are conflating desperate things.

If Trump refuses to answer questions in a Depo on a civil case, I assume he is not in police custody at the time, I assume he is pleading the fifth, and using his mindset it means he is guilty.

Poor Delusional Damo.

He also says dumb crap like "Why are you pleading the fifth?" when he knows that if he was Trump's attorney he would tell him to shut up regardless of guilt or innocence.

Where/when did I say something dumb like “Why are you pleading the fifth? You are putting words in my mouth then calling me dumb for it!

Because that is a lie, and if I was an attorney I might lose my license by making a mockery of the judicial system.

Bill Clinton was not in police custody and sleeping with Monica was not a crime so legally the 5th was not a legal option for him.
