Because insurrection most certainly IS a crime, and a federal one at that, punishable by fines, up to 10 years in prison, AND a ban on holding public office. When and if (BIG if) he is charged with insurrection, rest assured, to be convicted intent will surely rear its ugly head. The “oh c’mon man! EVERYONE knows he did it!” Strategy ain’t gonna work.
