At any rate, the media and JPPers keep referring to this as a rape trial. It is not. It is a defamation trial where the defamation stems from the alleged rape. Ms. Carroll must 1) show with a preponderance of the evidence that she was assaulted, 2) that Trump then defamed her by calling her a liar and other things he said, and 3) that the defamation resulted in emotional and/or economic damage to Ms. Carroll.
The discussion serves as an excellent way to identify our forum misogynists as well.

I expect that she may also have to prove that that is why she was fired. That being said, Trump is treating this like some episode of his old Apprentice game show, rather than a serious matter. Judges dislike that. Juries HATE it. The fact that his attys won't put him on the stand makes him look like he's hiding something, too.

It's a civil trial, not a criminal trial and the standards of evidence are different.
As I understand it, Ms. Carrolk's lawyers are calling witnesses who will swear under oath that Trump sexually assaulted them, and they're going to show the jury tapes of Trump bragging about grabbing pussy, to establish evidence that Trump is a sexual predator.
Trump could still win this trial, because everything depends on the credibility of the witnesses and Ms. Carol, and I don't think that's a sure bet in the eyes of a jury
