Man enters wrong house, gets shot

I have night sights. I know my house better than any intruder, I would use the dark in my favor. However, the drunk would likely find a switch and turn it on... If he wasn't planning on acting nefariously.

The idea that he is innocent because he was drunk is weird to me. How do we know it was an accident? (I should probably read the article... lol).

The homes in Foster City do tend to resemble each other so it is believable that someone go to the wrong house.

I'd order him on the floor with his hands behind his back. If he refused he'd die.

It's always good to take some inventory every now and then. Look around you, think what you would do. Then go on watching TV, it shouldn't be your life but there is nothing wrong with being prepared. Every room in your house has stuff you can use as weapons with real effect if you have some mental preparation.

it would help if he were armed, at least under ca law, however, the usual thing told to homeowners by cops is 1. make sure that the intruder is in the house (in other words drag him in) 2. make sure that there is a weapon in his hand (take a knife from the kitchen and put it in his hand, especially if he is dead)

however, i am not up on the recent changes in ca law regarding using deadly force against an intruder

but, i think that most juries would acquit in this circumstance, but i would not want to bet my freedom on it

Your first presentation, regarding dragging someone into your house, is BS.
First off they would be able to tell that he had been dragged, second the forensics would prove that the body had been moved.
This is nothing but a sure way of getting yourself arrested for any number of reasons.

Second; don't you thnk that the knife wouldn't be tested for fingerprints and then if it resembles yours, then they're going to check to see if he's been in your kitchen.

the knife would have both your and the victims fingerprints

when i was told the thing about dragging, it was back in the 70s

forensics has come a long way since then

oh well

If the dude entered my house uninvited he would be in danger of getting shot. Seriously, I can't imagine just letting people run through my house trying to figure out why the furniture changed.

Same way I feel.
I have no intentions of asking the intruder to please stand still, so I can turn the lights on.
He's going to get shot, until he falls or I'm out.

I just realized how sexist I am being in this post, by implying that only a man would attempt to illegally enter my house. Make no mistake, if said individual had ovaries, they would be treated the same.
I'm a bit of a sexist, if it was a woman, she might get one warning. Infinitely more than the man would get.

invite them in first and when they are all the way in then blast away and be sure to put at least one knife in their hands

one time they knocked on my door on a saturday morning and i answered the door naked with a two handed broadsword in my hands...they hurriedly left

They used to come around the neighborhood I lived in pretty often. One day they knocked and I answered the door with a ball python around my neck. They never came back to my door, even though I saw them in the neighborhood. Funny how that reptile made my soul less important. lol

what if you could tell that he was drunk and unarmed?

One of the benefits of living out in the country is that this sort of thing doesn't happen. No one stumbles into our yard, much less our house, without knowing they are not at their home.

That said, whether he survives or not would depend on when he did this stumbling. I work out of town. If he stumbled in when I was home he might survive if he followed the instructions. However, if he stumbled in at 4am when I was out of town he would be a dead drunk. My wife may be a little thing, but she doesn't play when it comes to keeping herself and our daughter safe.

When a stranger enters someone's home at 4am, I think getting shot is pretty much an expectation. And I have no problem with that.

If you have nothing, go into the master bath and pull off the towel rack bar. Even a small man can pull it off, and any weapon is better than nothing.

This is a 'man' from Ohio and a grad of USC... while a small man could pull it off, that combo leaves the situation in doubt.

You know Damo, sometimes I take for granted why I don't have weapons at my house. Some people have signs that say beware of dog or owner is a shooter in front of their house. My place just has a sign that says 'Cawacko Lives Here'. In the urban dictionary that is code for if you enter unwelcomely you will not exit alive. So unless a person has a death wish they aren't coming into my place.

I have a magnet on my door that says "Be Nice or Leave"

I think it makes a huge difference.

One thing the article doesn't really state is how the guy got into the house but I think we can surmise the front door was left unlocked. As far as safety goes wouldn't locking your doors be step number one?

We have 3 dogs, so the sign is unnecessary. While one is a miniature dachund, the other two would give an intruder pause. The Walker Coonhound is a little better than medium sized, and the Weimerainer is a huge beast. Best alarm system in the world.

So, once again, I can't see this situation happening at our house.

My sweet little terrier mix is my protector, and my good friend, Louievile slugger is by my bed. I can still swing a bat pretty good and my hubby taught me the Golden Rule, let them come to you, and when they do, they get to meet Louie!

Man, I can't imagine shooting someone & then finding out it was just a drunken kid or something.

There is no way to know how I or anyone would really react in those circumstances, but I'd hope there would be more of an opportunity to assess a real threat, and more of an effort to incapacitate as opposed to kill if the circumstances warranted.

I know, I am the same way. It just saddens me to think of a foolish kids life being taken for a bad mistake.

Once, if I were single that might be an option. But with a wife and child depending on me to protect them, I would not hesitate.

It has been mentioned in a previous post that the front door was obviously left unlocked. Even out here we don't do that. So all of my nightmares of waking to find someone in my home involve them breaking in.
